Terms of Use

BharatCET’s mission is to Empowering through Education. We enable anyone anywhere to create and share educational content (instructors) and to access that educational content to learn (students). We consider BharatCET marketplace model the best way to offer valuable educational content to our users. We need rules to keep our platform and services safe for you, us, and our student and instructor community. These Terms apply to all your activities on the BharatCET website, the BharatCET mobile applications and other related services. If you publish a course on the platform of BharatCET, you must also agree to the Instructor Terms. 

Instructor Terms

When you sign up to become an instructor on the platform of BharatCET, you agree to abide by these Instructor Terms. These Terms cover details about the aspects of the BharatCET platform relevant to instructors, the general terms that govern your use of our Services. Any capitalized terms that aren't defined in these Terms are defined as specified in the Terms of Use.

1. Instructor Obligations

As an instructor, you are responsible for all content that you post, including lectures, quizzes, coding exercises, practice tests, assignments, resources, answers, course landing page content, labs, assessments, and announcements.

You ensure that:

you have the required qualifications, credentials, and expertise (including education, training, knowledge, and skill sets) to teach and offer the services that you offer through your Submitted Content and use of the Services; and

you will Practice values that are fair and unbiased to all students, regardless of caste, creed, religion, gender, or economic background.

You will maintain a dignified manner appropriate for a instructor who serves as a role model.

you will prioritize the health, growth, and progress of students.

you will promote equality and assist learners in becoming self-assured and value-oriented human beings.

you will maintain public trust and confidence in the teaching profession by demonstrating honesty and integrity.

you will Strive to form fruitful partnerships with parents, students and other stakeholders.

you will Maintain public trust and confidence in the teaching profession by demonstrating honesty and integrity.

you will Provide a level of service that is consistent with industry standards and teaching services in general.

you will Respect intellectual property rights. Your assignments and delivered content should be exclusive and should not infringe or misappropriate the intellectual property rights of any third party.


You ensure that you will not:

engage in any activity that would require us to obtain licenses from or pay royalties to any third party, including the need to pay royalties for the public performance of a musical work or sound recording;

post or provide any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, incorrect, infringing, defamatory or libellous content or information;

use the Services for business other than providing tutoring, teaching, and instructional services to students;

Publish, post, transmit any unsolicited or unauthorized advertising, promotional materials or any other kind of solicitation through the official BharatCET platform.

Impersonate someone else or get illegal access to someone else's account.

Abuse or exploit BharatCET resources, software, network, support services for personal benefits.

Utilize the Services for any purpose other than providing students with mentoring, teaching, and instructional services.

interfere with or otherwise prevent other instructors from providing their services or content; or

misusing the resources of BharatCET, including support services.

2. BharatCET’s Rights

We own the platform of BharatCET and Services, including the website, present or future apps and services like our logos, API, code, and content created by our employees. You can’t tamper with those or use them without authorization. All rights, titles, and interests in and to the platform of BharatCET and Services, including our website, our existing or future applications, our APIs, databases, and the content our employees or partners submit or provide through our Services (but excluding content provided by instructors and students) are and will remain the exclusive property of BharatCET and its licensors. Our platforms and services are protected by copyright, trademark, and private policy. Nothing gives you a right to use the name of BharatCET or any of the trademarks, logos, domain names, and other distinctive brand features of BharatCET. Any feedback, comments, or suggestions you may provide regarding BharatCET or the Services is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

You may not do any of the following while accessing or using the platform of BharatCET and Services:

copy, modify, or otherwise attempt to discover any source code of or content on the platform of BharatCET and Services.

disable, interfere with, or try to circumvent any of the features of the platforms related to security or probe, scan, or test the vulnerability of any of our systems.

access or search or attempt to access or search our platform by any means (automated or otherwise) other than through our currently available search functionalities that are provided via our website, mobile apps, or API (and only pursuant to those API terms and conditions). 

in any way use the Services to send altered, deceptive, or false source-identifying information interfere with, or disrupt, (or attempt to do so), the access of any user, host, or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the platforms or services, or in any other manner interfering with or creating an undue burden on the Services.

We reserve the right to remove content, suspend or ban instructors for any reason at any time, without prior notice, including in cases where:

content falls below our quality standards or has a negative impact on the student experience;

an instructor engages in behaviour that might reflect unfavourably on the platform of BharatCET or bring BharatCET into public disrepute, contempt, scandal, or ridicule;

an instructor engages the services of a marketer or other business partner who violates BharatCET’s reputation;

an instructor uses the Services in a way that constitutes unfair competition, such as promotion of their off-site business in a way that violates BharatCET’s reputation; or

as determined by BharatCET in its sole discretion.

3. Relationship to Other Users

Instructors don't have a direct contractual relationship with students, so the only information you'll receive about students is what is provided to you through the Services. You agree that you will not use the data you receive for any purpose other than providing your services to those students on the platform of BharatCET, and that you won't solicit additional personal data or store students' personal data outside the platform. 

4. Price Setting

When creating your account and accordingly course available for purchase on BharatCET, you will be free to select a base price for your content and services.

As an instructor, you may also participate in certain marketing and promotional programs of BharatCET. In case you choose to avail yourself of the opportunity of participating in promotional activities you might have to change the base prices as per the terms of our promotion policy. 

We may increase the sale price of course/content at our discretion based upon the required taxes which may vary as per situations.

BharatCET shall be permitted to share your content for free with our team, with selected partners, other official social media handles in future. You understand that you will not receive any revenue share in these cases.

5. Promotional Programs

BharatCET reserves the right to conduct various marketing and promotional programs in which you can choose to participate, to increase your reach and increase your revenue potential on the BharatCET platform.

There is no up-front cost to participate in these programs, and you can modify your participation status at any time, though changes you make will not apply to currently active campaigns and certain programs may have additional requirements on termination.

6. Revenue Share

When a student purchases your course/content, we calculate the gross amount of the sale as the amount received by BharatCET from the student. From this, we subtract any Transaction Taxes, and any amounts paid to third parties in connection with the Promotional Programs to calculate the net amount of the sale.

The revenue share will be based on the net amount of sale.

7. Receiving Payments

For us to pay you promptly, you must share your activated bank account/other related details and must keep us informed of the correct details/any changes associated with your account. 

Depending on the revenue share model, once any of your course purchases happen and the student pays the required amount, the whole amount will be added/reflected in the Escrow account. After a float of 5 days, your revenue share will be sent to the bank account which has been provided by you. 

8. Refunds

Once the course has been subscribed the student will not be able to avail of any refund at any point of time during or after the duration of the subscription.

BharatCET reserves the right to change the refund policy at any point and the instructor will have to abide by the same.

9. Promotional Programs

BharatCET reserves the right to conduct various marketing and promotional programs in which you can choose to participate, to increase your reach and increase your revenue potential on the BharatCET platform.

10. Trademarks

While you are a published instructor and subject to the requirements below, you may use trademarks of BharatCET where we authorize you to do so.

only use the images of trademarks of BharatCET that we make available to you time to time.

Use only BharatCET trademarks in connection with the promotion and sale of your content on BharatCET. 

You must:

Use the pictures of only BharatCET trademarks that we provide, as outlined in the rules we may issue.

Use BharatCET trademarks solely in conjunction with the marketing and sale of your BharatCET-based submitted content.

immediately comply if we request that you discontinue use.

You must not:

Use BharatCET trademarks in a deceptive or derogatory manner;

Use BharatCET trademarks in a manner that indicates we endorse, sponsor, or approve of your submitted content or services.

Use BharatCET trademarks in a way that violates applicable law or in connection with an obscene, indecent, or unlawful topic or material.

If you are willing to use your trademarks or any other trademarks in the study material you provide for the course then you have to seek prior consent of BharatCET.  BharatCET will approve it only after considering negotiable terms and conditions.

11. Relationship Between Us

You and we agree that no joint venture, partnership, employment, contractor, or agency relationship exists between us.

12. Intellectual Property Ownership and Rights Notices

Copyright, trademark, and other laws protect the Site, Application, Services, and Collective Content in India. You acknowledge and agree that BharatCET and its licensors are the only owners of the Site, Application, Services, and Collective Content, as well as all associated intellectual property rights. Any copyright, trademark, service mark, or other proprietary rights notices included in or accompanying the Site, Application, Services, or Collective Content will not be removed, altered, or obscured by you. All BharatCET trademarks, service marks, logos, trade names, and other intellectual designations used on or in conjunction with the Site, Application, Services, and BharatCET Content are BharatCET trademarks or registered trademarks in India and elsewhere. Trademarks, service marks, logos, trade names, and any other proprietary designations of third parties used on this website are trademarks, service marks, logos, trade names, and any other proprietary designations of third parties used on this website are or in connection with the Site, Application, Services, and BharatCET Content are used for identification purposes only and may be the property of their respective owners. As a Member, you understand and agree that you are bound by the additional Terms, Guidelines and Policies that apply to your use of the Site, Application, Services and Collective Content, including BharatCET's Trademark & Branding Guidelines.

13. Copyright Policy

BharatCET complies with all copyright laws and excepts its users to do as well policy is to terminate the BharatCET Accounts of Members or other account holders who consistently infringe or are suspected of infringing on the rights of copyright holders in suitable situations.

Instructor must sure that they will not infringe the Copyrights of any third party. If anyone claims to be infringement of their copyrights then BharatCET will not be liable for any claims. Instructor have to settle down these claims by itself only. In that case BharatCET reserves all the rights to terminate the instructor’s services in the BharatCET.

14. Appearance and Setting or (minimum eligibility criteria for joining)

Whiteboard/Digital board- Trainer must have one of these boards for teaching and conducting live classes.

Camera quality- The video resolution should be in high definition (720 pixels).

Voice quality- There should be no ambient noise or other sounds that could distract the learner. 

Background- The background of the session must be a plain white background. 

Lighting- Lighting shall be bright enough for learners to see and view the trainer’s face.

Equipment, hardware and software required for conducting online live classes should be arranged by the instructor only and BharatCET is not liable to provide any such equipment to any trainer/instructor. The minimum basic requirement for the equipment are listed below:

o Laptop or desktop with a minimum configuration of Intel I5 processor and 8th generation.

o A laptop or desktop should have a minimum of Windows 10 to be installed.

o Laptop or desktop should have 8GB /16GB RAM And hardware of one or two TB.

o HD webcam with minimum 720P to 1080P resolution.

o High-quality microphone.

o Digital writing pad.

o External light source device.

o Basic software for online video casting.

o Video editing software.

o MS PowerPoint minimum 2016 version.

o Camera software.

o Adobe Flash Player.

15. Confidentiality and Non-Disclosure Agreement:

You have to keep confidential the information you receive from the company and prospective customers (Students, learners, institutions and other entities). All information of a competitively sensitive will also be kept confidential by you. Any information with you will not be shared in any form (written or verbally).

If you subscribe a course on the platform of BharatCET, you must also agree to the Students Terms.

We own the platform of BharatCET and Services, including the website, present or future apps and services like our logos, API, code, and content created by our employees. You can’t tamper with those or use them without authorization. All rights, titles, and interests in and to the platform of BharatCET and Services, including our website, our existing or future applications, our APIs, databases, and the content our employees or partners submit or provide through our Services will remain the exclusive property of BharatCET and its licensors. Our platforms and services are protected by copyright, trademark, and privacy policy. Nothing gives you a right to use the name of BharatCET or any of the trademarks, logos, domain names, and other distinctive brand features of BharatCET. Any feedback, comments, or suggestions you may provide regarding BharatCET or the Services is entirely voluntary and we will be free to use such feedback, comments, or suggestions as we see fit and without any obligation to you.

2) Student Obligation

No part of this application should be, reproduced, stored in retrieval system, or transmitted, in any form, or by any means, electronic, mechanical, photocopying, recording, or otherwise, without obtaining prior approval in writing from authors. 

In connection with registering for and using the Service, you must agree 

(i) to provide and maintain accurate, current and complete information about you as requested by BharatCET; 

(ii) to maintain the confidentiality of your password and other information related to the security of your account; 

(iii) to be fully responsible for all use of your account and for any actions that take place through your account; 

(iv) By signing up on BharatCET you deemed to have given your consent to be contacted by us via phone calls and/or SMS notifications and offer you our services, imparting product knowledge, offer promotional, offers running on website/app, you still authorize BharatCET to give you a call for the above-mentioned purposes; 

(v) Students will not be able to use paid services from BharatCET platform once your course subscription duration is over. 

We assure you that we will not use this information for any other purpose or share this information with any third party

As a Member, you understand and agree that you are bound by the additional Terms, Guidelines and Policies that apply to your use of the Site, Application, Services and Collective Content, including BharatCET's Trademark & Branding Guidelines.

4) Confidentiality and Non-Disclosure Agreement:

You have to keep confidential the information and the content you receive from the BharatCET and the instructors.  Any information with you will not be shared in any form (written or verbally).

5) Refunds

Before subscribing to any paid course, a student would be provided with 2 free classes as a demo. If the student likes it & wants to avail the services further, he/she would have to pay the respective course fee. 

Once the course has been purchased the user will not be able to avail any refund at any point of time during or after the duration of the subscription.

BharatCET reserves the right to change the refund policy at any point and the student will have to abide by the same.
